Who is responsible for processing your data?

TESTA HOME, S.L. (hereinafter, TESTA HOME) is tasked with processing your data on behalf of other responsible entities.

The party responsible for the processing of the data is the entity owning the property that has entrusted TESTA HOME with the arrangements associated with the sale and/or rent of this property, with TESTA HOME being responsible for the marketing of the property.

The duties of the DPD include informing and advising TESTA HOME and its employees  regarding compliance with the obligations set out in data protection regulations (the GDPR, the Spanish law on the Protection of Personal Data and Guaranteeing Digital Rights, the LOPDGDD, and other developing legislation); overseeing compliance by TESTA HOME with the provisions of data protection regulations; providing advice when required regarding  impact assessments in respect of the protection of the data processed, if necessary; notifying the Spanish Data Protection Authority (the AEPD) of any significant infringement in respect of data protection, proposing measure to prevent this conduct from continuing; co-operating with the controlling authorities, consulting with them and acting as a point of contact with them; and maintaining a register of processing operations.

The DPD will carry out other duties in addition to those outlined, and will perform all these whilst paying due attention to the risks associated with processing operations, taking into account the nature, scope, context and purposes of the processing.

TESTA HOME is not obliged to appoint a Data Protection Delegate, but has done so in order to ensure greater and better protection of your data.

 

What are the purposes of the processing of your data?

1.- To attend to and carry out the correct management and administration of our service.

We will use your data, directly or through estate agents, who act as the parties responsible for processing, to attend to, manage and administer our property rental services, reply to your doubts and requests, and to register you with the various utilities.

2.- To attend to and manage your requests by calling you by phone.

If you have provided us with your contact details so we can call you or return your call, we will use these to return your call and deal with the request or question you have.

3.- To manage, administer, present, extend and improve our services.

We will use your data in order to manage, administer, present, extend and improve our services so you enjoy a better browsing experience. In addition, we will carry out quantitative and qualitative studies into the visits and the use of our services in order to improve their quality.

4.- To consult and communicate data to credit information systems.

Both prior to the signing of your lease and during its execution we will consult credit information systems (ASNEF-EQUIFAX), and the Central de Información de Riesgos del Banco de España (CIRBE) to analyse your credit status.

If the tenant has any due, cleared and payable on demand debt, whose existence or amount has not been subject to administrative or legal demand by the debtor or via a binding alternative dispute settlement procedure with the owner of the property, under the terms and conditions envisaged in applicable legislation (article 20 LOPDGDD), TESTA HOME can include the data in credit information systems (ASNEF-EQUIFAX soluciones.equifax.es, Paseo de la Castellana 259D, 28046, Madrid) while non-compliance continues, and these will be jointly responsible for the data included.

5.- To manage the sending of proprietary commercial information by any means, including electronically.

We will use your data to send you personalised commercial communications (on the basis of the information we have about you, such as age, gender, place of residence, interests expressed, etc.), about the property sector that we consider could be of interest to you by any means, automatic or otherwise (post, SMS, MMS, e-mail, Internet, telephone…)

6.- To send commercial information about Group companies

If you give us your consent, we will send your data to Group companies (Especificar empresas del Grupo) so they can send you commercial communications about the property sector that we consider could be of interest to you by any means, automatic or otherwise (post, SMS, MMS, e-mail, Internet, telephone…)

7.- To send third-party commercial information

If you give us your consent, your data could be processed for the sending of commercial information and offers, by any means, automatic or otherwise (post, SMS, MMS, e-mail, Internet, telephone…), of companies of the following sectors of activity in relation with the properties such as products  and services of decoration, interior decorating, cleaning services, moving services, furniture, maintenance and concierge services  (concretar los sectores de los que se pretende enviar ofertas).

TESTA HOME, GROUP companies and collaborating third party companies will consult the appropriate Mail Preference Service lists to avoid sending unwanted advertising.

 

How long will we keep your data?

The data provided will be kept while the lease remains valid and during the limitation period for any actions which may derive from this and which generally is a period of 5 years from the ending of the lease (article 1964 of the Spanish Civil Code). However, this will depend on the type of action to be taken (articles 1962 to 1972 of the Spanish Civil Code), without prejudice to the possibility of your exercising your right of deletion, in which case we will block your data during the time that the legal obligations last.

Data provided for the management of reservations that have not ended in the signing of a lease will be kept for a period of 18 months, on the understanding that this is a reasonable period of time during which the client may finally decide to sign the lease or during which legal or other kinds of consequences may arise for the contracting parties.

The data provided will be processed for the sending of proprietary commercial communications during the validity of the lease signed or until you oppose this processing. If you have given us your consent, your data will be processed for the sending of proprietary commercial communications until you withdraw your consent.

The data provided will be processed for the sending of proprietary commercial communications during a period of approximately 2 months if you are not a client or until you oppose this processing.

What is the legitimation for the processing of your data?

1.- The legitimation for the processing of the data in order to attend to and carry out the correct management and administration of our service is based on precontractual measures and on the execution of the lease on the property.

2.- The legitimation of the processing of the data in order to contact you by making or returning a phone call to the contact number provided, is based on compliance with the request you have made of us to contact you, that can be understood to be a precontractual measure or a measure for the execution of the lease on the property.

3.- The legal basis of the management, administration, presentation, extension and improvement of our services is our legitimate interest and yours as user. TESTA HOME uses your data in order to carry out better management, administration, presentation, extension and improvement of our services without which this would not be possible, being able in this way to provide a more flexible, clear, transparent and efficient service. In this regard, TESTA HOME has made a considered judgement and on the basis of an analysis of how the data is processed and the reasonable expectations of the person affected, has concluded that this does not infringe personal data protection regulations and the rights of the interested parties, as the legitimate interest of the party responsible for the processing and your own in obtaining this better service prevail over the rights of the user that their data be used without their having given their consent to this. However, you may at any time you wish oppose the processing of your data for this purpose.

4.- Data processing with the aim of assessing solvency is based on the execution of pre-contractual measures and the legitimate interest of the owner of the property and of the client themselves in order to ensure the tenant has sufficient solvency to be able to pay the  rent instalments and so avoid becoming over indebted. So, in accordance with this legitimate interest, when it comes to carrying out said processing and on the basis of the reasonable expectations of the interested party that this processing be carried out with their personal data, TESTA HOME has made a considered judgement concluding that the legitimate interest prevails over the rights of the client that their personal data not be processed without their having given their consent to this. However, you may at any time you wish oppose the processing of your data for this purpose.

5.- The sending of proprietary commercial information is based on the legitimate interest of the owner of the property.

At TESTA HOME, after making a considered judgement and on the basis of the way in which personal data processing is carried out, we consider that the legitimate interest of communicating with our clients and informing them of similar products to those previously acquired prevails over their right for their data not to be processed without their prior explicit consent, and believe that this is in accordance with their reasonable expectations.

However, you may at any time you wish oppose the processing of your data for this purpose.

In addition, always provided you have given your consent, we will send you proprietary commercial information once your lease has expired, without, in any instance, the not giving or subsequent withdrawal of this consent conditioning the execution of the lease signed.

6.- The making of commercial property sector offers by Group companies, is based on the consent you have given us, where appropriate, without, in any instance, the not giving or subsequent withdrawal of this consent conditioning the execution of the lease signed.

The consents obtained for the purposes mentioned above are independent of each other so the user may withdraw just one of these without affecting the rest.

What data do we process?

We only use the data that you have directly provided us with and do not obtain other personal data from other private or public sources.

The data asked for are, in general, mandatory in order to comply with the established purposes (unless specified otherwise in the required field).

The communication of the data required in this document by the interested party is a legal or contractual requirement and necessary for the envisaged purposes, so these must be provided in order to be able to render the service offered by TESTA HOME (unless specified otherwise in the required field), and if the interested party refuses to provide these they will not be able to receive the service offered by TESTA HOME. What are your rights when you provide us with your data and how can you exercise them?
